How do European Regulators Enforce Recycling Regulations?

European regulators are enforcing Extended Producer Responsibility (EPR) recycling regulations, and actions they are taking to identify and punish non-compliance include:

  • Non-compliant companies are being denied market access

  • Online marketplaces are obligated to check whether sellers are registered

  • Tesla was fined €12 million for non-compliance to the batteries regulations

  • Companies are encouraged to identify competitors’ non-compliance in each country and report them to regulators via ‘whistle blower’ websites

  • Rogue waste processor in the UK defrauded a producer compliance scheme and it’s producer members out of GBP 1.5 million
